Terms and Conditions

1. Agreement
This Short-Term Rental Agreement (“Agreement”) is made by and between [Your Name] (“Owner”) and the individual or individuals booking the property (“Guest”). By booking the property, the Guest agrees to abide by these terms and conditions.

2. Rental Period
The rental period begins at 15.00 on [Start Date] and ends at 12.00 on [End Date]. Early check-in or late check-out is subject to availability and may incur additional charges.

3. Payment Terms
– **Booking Deposit:** A non-refundable booking deposit of 30% of the total rental amount is required to secure the reservation.
– **Final Payment:** The remaining balance is due 14 days before the start of the rental period.
– **Accepted Payment Methods:** Payment can be made via credit card, PayPal, etc.

4. Cancellation Policy
– **Cancellation by Guest:** Cancellations made >7 days before the start of the rental period will receive a 80% refund of the total rental amount. Cancellations made less than 7 days in advance will forfeit the full rental amount.
– **Cancellation by Owner:** In the unlikely event that the Owner cancels the reservation, a full refund of all payments will be made to the Guest.

5. House Rules
– **Maximum Occupancy:** The maximum occupancy of the Property is 7 guests. Exceeding this limit is grounds for immediate termination of the rental without refund.
– **No Smoking:** Smoking is strictly prohibited inside the Property. If evidence of smoking indoors is found, the Guest will be charged an additional fee of €500 for deep cleaning and odor removal. The Guest agrees to pay the additional amount immediately upon request.
– **Pets:** Pets are not allowed on the Property.
– **Noise:** Guests are expected to respect the surrounding area  and keep noise to a minimum, especially between 22.00 and 07.00.

-**Environmental Responsibility:** Guests are encouraged to take care of the environment and surrounding nature. Please:

  • -Avoid littering and dispose of waste properly in designated bins.
  • -Recycle where possible using the provided recycling bins.
  • -Refrain from disturbing local wildlife and natural habitats.

– **Cleanliness:** The Property must be left in the same condition as it was found. Excessive cleaning required after check-out will result in additional charges.

6. Use of Property
– **General Use:** The Property is to be used for residential purposes only. It shall not be used for commercial activities, illegal activities, or any purpose that could disturb the peace of the neighborhood.
– **Special Events:** Any special events or gatherings that exceed the maximum occupancy require prior approval from the Owner and may be subject to additional fees and conditions.
– **Alterations and Decorations:** No alterations, additions, or decorations may be made to the Property without the Owner’s prior written consent.

7. Guest Responsibilities
– **Damage:** The Guest is responsible for any damage to the Property during the rental period. The cost of repairs or replacements will be deducted from the security deposit. If damages exceed the deposit, the Guest agrees to pay the additional cost.
– **Personal Property:** The Owner is not responsible for any loss or damage to the Guest’s personal property during the rental period.

8. Liability
– **Injury:** The Owner is not liable for any injury, illness, or death of any Guest during their stay. The Guest acknowledges that the use of the Property, including but not limited to the stairs, balconies, outside area and any recreational equipment, is at their own risk.
– **Force Majeure:** The Owner is not liable for events beyond their control that may affect the Guest’s stay, including but not limited to natural disasters, acts of God, war, or government regulations.

9. Check-Out Procedure
– **Check-Out Time:** The check-out time is 12.00 on [End Date].
– **Before Departure:** The Guest is required to:
– Remove all trash from the Property.
– Wash and put away all dishes.
– Return all keys to the designated location.
– Ensure that all doors and windows are locked.

10. Governing Law
This Agreement is governed by the laws of Norway. Any disputes arising out of or related to this Agreement shall be resolved in the courts of Salten & Lofoten district court.

11. Amendments
This Agreement may only be amended in writing and signed by both the Owner and the Guest.

12. Acceptance
By making a reservation and paying the booking deposit, the Guest acknowledges that they have read, understood, and agree to abide by these Terms and Conditions.

13. Privacy and Data Protection (GDPR Compliance)

  • Data Collection: The Owner collects personal information from the Guest, including but not limited to name, contact details, payment information, and any other details provided during the booking process. This data is collected to manage the booking, facilitate communication, and provide the services associated with the rental.
  • Data Use: The personal data collected will be used solely for the purposes of managing the rental agreement, processing payments, and complying with legal obligations. The Owner may also use the data to contact the Guest regarding their stay or for feedback purposes.
  • Data Storage: The Owner will securely store the Guest’s personal data for as long as necessary to fulfill the purposes for which it was collected, or as required by law. The data will be deleted or anonymized when it is no longer needed.
  • Data Sharing: The Owner will not share the Guest’s personal data with third parties, except where necessary for the provision of services (e.g., sharing with payment processors) or as required by law.
  • Guest Rights: Under GDPR, the Guest has the right to:
    • Access their personal data held by the Owner.
    • Request correction of any inaccuracies in their personal data.
    • Request the deletion of their personal data, subject to legal requirements.
    • Restrict or object to the processing of their personal data.
    • Request a copy of their personal data in a commonly used format (data portability).

  • Consent: By making a booking, the Guest consents to the collection, use, and processing of their personal data as described in this section.
